More importantly, it\u2019s critical to understand how HMRC expects you to calculate and report your taxes, and in this guide, you\u2019ll learn all about it and more.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-how-does-hmrc-view-cryptocurrency\"><strong>How Does HMRC View Cryptocurrency<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">HMRC (Her Majesty\u2019s Revenue and Customs) haven&#8217;t clarified its stance on cryptocurrency. So far, all we know is they don&#8217;t consider crypto as currency or money. However, the first \u00a312,300 is tax-free for UK taxpayers under the Annual Exempt Amount.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In case you realize a loss, you can use it to offset your gains and reduce your net taxable gain. There is no limit on how much you can offset nor any time limit, meaning you can carry forward your losses indefinitely.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But make sure you report your losses within the first four years of incurring them. Otherwise, you can&#8217;t claim those losses.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-income-taxes\"><strong>Income Taxes<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">When you receive crypto as a form of payment or income, you\u2019ll be subject to income tax rates ranging from 0% to 45%. <a href=\"https:\/\/bitcoin.tax\/blog\/crypto-mining-taxes\/\" target=\"_blank\" rel=\"noreferrer noopener\">Crypto mining<\/a> or getting paid in crypto are some examples where you\u2019re liable to income taxes.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Much like capital gains, you also receive a personal allowance of \u00a312,570 for your taxable income, meaning anything earn below that is tax-free.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Keep in mind that you\u2019ll pay taxes twice when receiving crypto as income &#8211; income taxes on receiving the crypto and capital gain taxes when you sell them in the future.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-taxes-on-defi-transactions\"><strong>Taxes on DeFi Transactions<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Very recently, HMRC released dedicated guidelines for DeFi, making the UK probably the first government to put out specific taxation guidelines around DeFi.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Anyways, here\u2019s how taxes on DeFi taxation works. Whenever you\u2019re adding liquidity or lending crypto in a DeFi protocol, in other words, exchanging your crypto for a token of proof, you\u2019re triggering a disposal event. Hence, you\u2019ll be subject to capital gain taxes.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Even though you technically still hold ownership of the coin, HMRC sees it as disposing of one cryptocurrency to acquire another.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On the other hand, receiving periodical, consistent and perhaps committed rewards or interests from the facilitator (DeFi protocol) will make you subject to income taxes.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That said, HMRC still left many nuances and exceptions undiscussed and unaddressed. You subtract the cost basis of your crypto by its selling price to calculate the gain.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Cost basis &#8211; Fair Market Value (or Selling Price) = Gain\/Loss<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The UK follows the ACB method to calculate the cost basis of your assets.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-how-does-the-acb-method-work\"><strong>How does the ACB method work?<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">It\u2019s easy. You just divide the total cost of the crypto you hold by the number of coins you hold of that cryptocurrency.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Since one can easily exploit the ACB method to manipulate their cost basis, hence, their taxes, HMRC has some specific rules in place to prevent taxpayers from practicing wash sales.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>What is wash sales?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It\u2019s when you sell crypto to realize a loss and quickly purchase it again to retain ownership and harvest losses simultaneously. You can say it\u2019s an extension of the tax-loss harvesting strategy.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Now, coming back to it, the HMRC prevents wash sales with the Same Day Rule and Bed and Breakfasting Rule. Basically, both rules state that if you buy and sell (or sell and buy) crypto on the same day or within the same month, you\u2019ll use the cost basis of the coin on that month or day to calculate gains and losses.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>For example &#8211;&nbsp;<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Suppose you sell 5 BTC for \u00a310,000 on July 5.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On July 16, you buy 5 BTC for \u00a39,000 again.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Now, since you have sold and bought the same crypto asset within a month, the Bed and Breakfasting Rule applies, according to which the cost basis of those 5 BTC would be \u00a39,000 again. Therefore, you would realize a capital gain of \u00a31000.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>And as for calculating income taxes &#8211;&nbsp;<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You pay income tax rates on the fair market value (FMV) of the crypto at the time of receiving it. So, if you receive 3 ETH as payment for a service and at the time of receiving, the FMV of 3 ETH is \u00a32500, that would become your taxable income and you would pay income tax rates on it.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pretty simple and straightforward, right? If it\u2019s not, use a crypto tax tool like <a href=\"http:\/\/bitcoin.tax\">Bitcoin.Tax<\/a> that will do all of this for you on autopilot.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-crypto-taxable-events\"><strong>Crypto Taxable Events<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The following are some common and frequent crypto transactions and their tax implications.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-selling-or-spending-crypto\"><strong>Selling or Spending Crypto<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">As we established before, when you\u2019re selling or spending your crypto, you\u2019re essentially disposing of them. Hence, attracting capital gain taxes.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-swapping-crypto\"><strong>Swapping Crypto<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Since swapping one cryptocurrency for another is also seen as a disposal event, its tax consequences follow the same logic as the previous taxable event.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-getting-paid-in-crypto\"><strong>Getting Paid in Crypto<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">If you&#8217;re getting paid in crypto for any service or product you sell, it&#8217;s essentially the same if you would have received your income in fiat currency. All you have to do is calculate the FMV of the crypto you receive at the time of receiving it and pay income tax rates on it.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But remember, you&#8217;ll pay capital gain taxes when exchanging your crypto for fiat currency, in other words, selling it.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-mining-crypto\"><strong>Mining Crypto<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Mining rewards earned from crypto mining are also treated as ordinary income in the UK. Therefore, it follows the same tax logic as the previous taxable event.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-staking-or-lending-rewards\"><strong>Staking or Lending Rewards<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">If you&#8217;re staking or <a href=\"https:\/\/bitcoin.tax\/blog\/crypto-loan-taxes\/\" target=\"_blank\" rel=\"noreferrer noopener\">lending crypto<\/a> in a DeFi protocol and receive a token in exchange for your original cryptocurrency, you&#8217;ll pay capital gain taxes.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-rewards-interests-from-defi-protocols\"><strong>Rewards\/Interests from DeFi Protocols<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">And rewards or interest earned from DeFi protocols will be treated as income. Hence, it will be subject to income taxes.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-airdrops\"><strong>Airdrops<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/bitcoin.tax\/blog\/airdrop-taxes\/\" target=\"_blank\" rel=\"noreferrer noopener\">Airdrops<\/a> are a little tricky. But as a general rule of thumb, if you complete any kind of tasks (like sharing on social media), survey or anything to receive the airdrop, you&#8217;ll be subject to income taxes on the FMV of the airdrops.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But if you receive an airdrop doing absolutely nothing, you&#8217;ll pay capital gain taxes on its FMV.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-gifting-crypto\"><strong>Gifting Crypto<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/bitcoin.tax\/blog\/crypto-gift-taxes\/\" target=\"_blank\" rel=\"noreferrer noopener\">Gifting crypto<\/a> is typically seen as a disposal event, hence, capital gain taxes, unless you gift it to your spouse or civil partner. Gifting crypto to your spouse or civil partner is tax-free, plus there&#8217;s no limit on it.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-tax-free-crypto-transactions\"><strong>Tax-Free Crypto Transactions<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The following are some tax-free crypto transactions in the UK:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-buying-and-holding-crypto\"><strong>Buying and Holding Crypto<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Buying and holding crypto doesn&#8217;t trigger a disposal event.
