In this article, we\u2019ll discuss how general tax laws in Denmark apply to cryptocurrency and how to navigate through different crypto transactions in regard to taxation.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-how-does-the-danish-tax-agency-view-cryptocurrency\"><strong>How Does the Danish Tax Agency View Cryptocurrency?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Danish Tax Agency or the Skattestyrelsen views cryptocurrencies as personal assets.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is interesting because personal assets in Denmark are taxable under two circumstances &#8211;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">a) It\u2019s a part of a business&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">b) It\u2019s owned for speculative purposes<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The first one is mostly irrelevant to us because most crypto transactions like buying, HODLing, day trading, mining and staking crypto come under speculative purposes. So, the second one is what we\u2019ll break down in this guide.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-how-is-crypto-taxed-in-denmark\"><strong>How is Crypto Taxed in Denmark?<\/strong><\/h2>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-large is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/bitcoin.tax\/blog\/wp-content\/uploads\/2022\/09\/How-is-Crypto-Taxed-in-Denmark-1024x1024.png\" alt=\"Crypto taxes in Denmark\" class=\"wp-image-2759\" width=\"400\" height=\"400\" srcset=\"https:\/\/bitcoin.tax\/blog\/wp-content\/uploads\/2022\/09\/How-is-Crypto-Taxed-in-Denmark-1024x1024.png 1024w, https:\/\/bitcoin.tax\/blog\/wp-content\/uploads\/2022\/09\/How-is-Crypto-Taxed-in-Denmark-300x300.png 300w, https:\/\/bitcoin.tax\/blog\/wp-content\/uploads\/2022\/09\/How-is-Crypto-Taxed-in-Denmark-150x150.png 150w, https:\/\/bitcoin.tax\/blog\/wp-content\/uploads\/2022\/09\/How-is-Crypto-Taxed-in-Denmark-768x768.png 768w, https:\/\/bitcoin.tax\/blog\/wp-content\/uploads\/2022\/09\/How-is-Crypto-Taxed-in-Denmark.png 1080w\" sizes=\"auto, (max-width: 400px) 100vw, 400px\" \/><\/figure>\n<\/div>\n\n\n<p class=\"wp-block-paragraph\">According to the guidelines provided by the Danish Tax Agency, any profit earned in crypto is taxed under income taxes.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>What does this mean?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It means two things &#8211;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">First, it means that every time you realize a gain (profit) by selling, spending or disposing of your cryptocurrency in any way, you\u2019ll be liable to income tax.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Second, if you receive crypto in the form of payment or salary, in other words, if you get paid in crypto for your products or services, you\u2019ll pay ordinary income taxes. It\u2019s the same as if you received them in fiat currency.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Except, there\u2019s one difference. When getting paid in crypto, you\u2019ll pay taxes twice. Once when you receive it and second when you sell or dispose of it in the future (more on how to calculate these taxes later).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Now that was the easy part. Let\u2019s introduce some more complexity.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">The income tax rates in Denmark are made up of four different taxes &#8211;<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Labor Market Contribution (LMC):<\/strong> LMC is a set tax rate of 8% that every taxpayer must pay.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Municipal Taxes:<\/strong> The municipal taxes usually vary, but on average, it\u2019s around 25%.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Bottom-Bracket Tax:<\/strong> The bottom-bracket tax rate is set at 12.11% and is applicable to anyone with an income.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Top-Bracket Tax:<\/strong> The top bracket tax rate is set at 15% and applicable on income which exceeds 552,500 DKK.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There are a couple of conditions that apply to these rules.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Firstly, you\u2019ll only calculate municipal, bottom-bracket or top-bracket taxes after deducting the personal tax allowance and the 8% LMC.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In case you\u2019re wondering, the personal tax allowance in Denmark is 46,700 DKK and is applicable to all adults (over the age of 18). FIFO stands for first-in-first-out, meaning your crypto assets are accounted for in the order you bought them.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Let us explain with an example &#8211;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Suppose you bought 1 BTC for $5000.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After a month, you buy another BTC for $7000.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Now, after another month, you sold a BTC for $10,000.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">So, what is the cost basis for the one you sold? Is it the one you bought first or the one you bought after a month?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Well, according to the FIFO method, it\u2019s the one you bought first. Hence, the cost basis is $5000. Hence, you realized a gain of $5000. (FMV or Sale Price &#8211; Cost Basis = Gain\/Loss)<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If you&#8217;re someone that actively invests or trades in crypto, you would probably need a crypto tax software like <a href=\"http:\/\/bitcoin.tax\" target=\"_blank\" rel=\"noreferrer noopener\">Bitcoin.Tax<\/a> to keep track of all this mess. Manually calculating all of this is not only time-consuming and stressful, but it also makes you prone to making errors.\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As for getting paid in crypto, you\u2019ll pay income taxes on the FMV (Fair Market Value) of the crypto at the time of receiving it. Also, this FMV will later become your cost basis when you sell the crypto in the future.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-crypto-taxable-events\"><strong>Crypto Taxable Events<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The following are some of the most common crypto transactions and their tax implications you should know about:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-selling-or-spending-crypto\"><strong>Selling or Spending Crypto<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">When selling, spending or swapping your crypto, you\u2019re essentially disposing of it. Therefore, if you realize a gain while disposing of your crypto assets, you\u2019ll pay income taxes on it.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-getting-paid-in-crypto\"><strong>Getting Paid in Crypto<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">As mentioned before, getting paid in crypto is treated the same as getting paid in fiat currency. You\u2019ll pay income taxes.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, remember that you must pay income taxes again when you dispose of those cryptocurrencies you received as income.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-mining-crypto\"><strong>Mining Crypto<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Rewards for <a href=\"https:\/\/bitcoin.tax\/blog\/crypto-mining-taxes\/\" target=\"_blank\" rel=\"noreferrer noopener\">mining crypto<\/a> are treated the same as getting paid in crypto, meaning you\u2019ll pay income taxes on your mining rewards.&nbsp;&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-staking-or-lending-rewards\"><strong>Staking or Lending Rewards<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">There are no official guidelines from the Danish Tax Agency on the taxation of interest-bearing crypto activities like crypto staking.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But from what we understand, based on the existing framework, <a href=\"https:\/\/bitcoin.tax\/blog\/what-is-defi-staking\/\" target=\"_blank\" rel=\"noreferrer noopener\">staking<\/a> and <a href=\"https:\/\/bitcoin.tax\/blog\/crypto-loan-taxes\/\" target=\"_blank\" rel=\"noreferrer noopener\">lending<\/a> rewards will be subject to income taxes the same as getting paid in crypto or mining crypto.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-airdrops\"><strong>Airdrops<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/bitcoin.tax\/blog\/airdrop-taxes\/\" target=\"_blank\" rel=\"noreferrer noopener\">Airdrops<\/a> follow the same logic as getting paid in crypto. Hence, income taxes.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-gifting-crypto\"><strong>Gifting Crypto<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Denmark does have a separate gift tax rate of 15%, but in most cases, <a href=\"https:\/\/bitcoin.tax\/blog\/crypto-gift-taxes\" target=\"_blank\" rel=\"noreferrer noopener\">gifting crypto<\/a> is free. Even if it\u2019s not, Denmark provides all taxpayers a gift tax allowance of 69,500 DKK (2022) if you gift someone who\u2019s related to you or has lived with you for a minimum of 2 years.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-tax-free-crypto-transactions\"><strong>Tax-Free Crypto Transactions<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The following are some crypto transactions that attract zero taxes and are totally tax-free.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-buying-and-holding-crypto\"><strong>Buying and Holding Crypto<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">As long as you&#8217;re not disposing of your assets, it&#8217;s not a taxable event.
