Crypto taxes in Spain can get a little complicated as soon as you introduce wealth taxes and autonomous community tax rates.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Wondering what they are?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That\u2019s what we\u2019ll discuss in this article, along with everything you must know about cryptocurrencies and their tax consequences in Spain.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-how-does-the-state-agency-for-tax-administration-of-spain-view-cryptocurrency\"><strong>How Does the State Agency for Tax Administration of Spain View Cryptocurrency?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The State Agency for Tax Administration of Spain views cryptocurrency as an asset for tax purposes.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-how-is-crypto-taxed-in-spain\"><strong>How is Crypto Taxed in Spain?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Broadly speaking, there are mainly two crypto taxes in Spain &#8211; Personal income tax and Wealth tax.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Personal income tax can be further divided into &#8211; general income tax and savings income tax.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Let\u2019s go over both individually.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-general-income-tax\"><strong>General Income Tax<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">General income tax is what you pay when you receive crypto as income or reward for a task.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Even though the government only confirmed general income tax for crypto received as income and <a href=\"https:\/\/bitcoin.tax\/blog\/crypto-mining-taxes\/\" target=\"_blank\" rel=\"noreferrer noopener\">crypto mining<\/a> rewards, it most likely will apply to staking rewards, lending rewards, and other interest-bearing activities as well.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The general income tax rate is a combination of a progressive tax rate set by the government and an <a href=\"https:\/\/countryeconomy.com\/taxes\/personal-income-tax\/spain-autonomous-communities\" target=\"_blank\" rel=\"noreferrer noopener\">autonomous community tax rate<\/a>, which varies based on where you live. You can also deduct your business expenses if any.\u00a0<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-saving-income-tax\"><strong>Saving Income Tax<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Savings income tax is the equivalent of capital gains taxes in other countries. This is what you pay when you sell, spend or swap your cryptocurrencies. In other words, when you dispose of your crypto.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The savings income tax ranges at progressive rates from 19% to 26% on your gains based on your income brackets and other factors.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Needless to say, you can also offset your losses. However, you can only offset 25% of your net capital gain each year. You\u2019ll pay savings income tax on the capital gain amount.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>For calculating general income tax, you just find out the FMV of the crypto at the time of receiving it.&nbsp;<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It\u2019s essential to keep these records, not only for tax declaration purposes but also because this FMV will become the cost basis of your crypto when you sell them in the future.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>For calculating wealth tax, you just find out the FMV of all your crypto holding at the time of tax declaration.<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-crypto-taxable-events\"><strong>Crypto Taxable Events<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The following are some common crypto transactions and their tax consequences &#8211;&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-getting-paid-in-crypto\"><strong>Getting Paid in Crypto<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">As we just discussed, you\u2019ll be taxed under general income taxes if you receive crypto as income.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-crypto-staking\"><strong>Crypto Staking<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The State Agency for Tax Administration of Spain didn\u2019t release any official guidelines around <a href=\"https:\/\/bitcoin.tax\/blog\/what-is-defi-staking\/\" target=\"_blank\" rel=\"noreferrer noopener\">staking<\/a> and other similar activities yet. But based on existing frameworks, you\u2019ll be most likely taxed under general income taxes for staking rewards.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The same goes for taxes on <a href=\"https:\/\/bitcoin.tax\/blog\/crypto-loan-taxes\/\" target=\"_blank\" rel=\"noreferrer noopener\">crypto lending<\/a> rewards and <a href=\"https:\/\/bitcoin.tax\/blog\/yield-farming-taxes\/\" target=\"_blank\" rel=\"noreferrer noopener\">yield farming<\/a> rewards in Spain.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-spending-crypto-to-buy-goods-services\"><strong>Spending Crypto to Buy Goods &amp; Services<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">When you use your crypto to buy goods and services, you\u2019re essentially disposing of your assets, triggering a taxable event, specifically savings income taxes.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-swapping-crypto\"><strong>Swapping Crypto<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Taxes on swapping crypto follow the same fundamentals as selling or spending crypto. When you\u2019re swapping one cryptocurrency for another, you\u2019re disposing of your crypto. Hence, you pay savings income tax on your gains.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-gifting-receiving-crypto-gifts\"><strong>Gifting &amp; Receiving Crypto Gifts<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">In Spain, <a href=\"https:\/\/bitcoin.tax\/blog\/crypto-gift-taxes\" target=\"_blank\" rel=\"noreferrer noopener\">gifting crypto<\/a> is seen as disposing of your assets. Hence, you\u2019ll pay savings income taxes on gifting crypto.\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As for recipients, they will pay gift tax or inheritance tax, which may range from 7% to 36.5%. It varies based on multiple factors like how much you receive, who gifted you, where you live, which autonomous community you report, etc.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-tax-free-crypto-transactions\"><strong>Tax-Free Crypto Transactions<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The following are the only two scenarios where you don&#8217;t pay any taxes on crypto in Spain.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-buying-holding-crypto\"><strong>Buying\/Holding Crypto<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Buying and holding crypto for as long as you wish is completely tax-free in Spain.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-transferring-crypto-between-wallets\"><strong>Transferring Crypto Between Wallets<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Transferring crypto from one wallet to another is not seen as a disposal of your assets. Hence, it\u2019s tax-free.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-how-to-avoid-crypto-taxes-in-spain\"><strong>How to Avoid Crypto Taxes in Spain<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">When we say how to avoid crypto taxes in Spain, we\u2019re not encouraging you to do tax evasion.
